How to apply for a priority certification document
1. Brief description
Within 6 months after the applicant files an application for trademark registration in China, If other member countries of the Convention apply to register the same trademark and claim priority, they should submit an application to the Trademark Office to provide priority certification documents.2. Processing channels
There are two ways to apply for priority certification documents:
(1) Entrust a nationally recognized trademark agency to handle the matter.
(2) The applicant goes directly to the trademark registration hall of the Trademark Office to apply.
3. Processing steps
(1) When entrusting a trademark agency to handle the matter, the applicant can voluntarily choose any nationally recognized trademark agency to handle the matter. All trademark agencies registered with the Trademark Office are published in the "Agency" column.
(2) The applicant goes directly to the Trademark Office for trademark registration To apply in the lobby, applicants can follow the following steps:
Prepare the application documents → Submit the application documents at the trademark registration hall acceptance window → Print the bar code at the coding window → Pay the application fee at the payment window
4. Preparation of application documents
(1) Application documents that should be provided
1. Provide application form for priority certificate;
2. Copy of the original trademark registration application;
3. Copy of acceptance notice;
4 , If you go directly to the trademark registration hall, submit a copy of the person in charge of the ID card; if you entrust a trademark agency to handle it, submit a trademark agency power of attorney.
(2) Specific requirements
1. Application documents should be typed or printed.
2. The applicant should stamp its seal on the application form providing priority certification documents.
5. Payment of fees
A fee is payable for each priority application.
If a trademark agency is entrusted to handle the application, the applicant shall pay the application fees and agency fees to the trademark agency. The application fees collected by the Trademark Office will be deducted from the advance payment of the trademark agency.
6. Obtaining the "Priority Certificate"
If the application documents are complete and the application procedures comply with the regulations, the Trademark Office will send it by mail Applicant's "Certificate of Priority".
If yes If a trademark agency is entrusted to handle the matter, the Trademark Office will mail the "Priority Certificate" to the trademark agency.
7. Notes
1. The address, postal code and phone number filled in by the applicant should be detailed and accurate to facilitate contact.
2. The original application materials provided by the applicant regarding trademarks, goods or service categories, designated goods or services, etc. should be accurate.
3. If you go directly to the trademark registration hall, the Trademark Office usually submits the application from the applicant. Within the next 2 weeks, the applicant will be notified to receive the "Priority Certificate" according to the contact address filled in the application form; if a trademark agency is entrusted to handle it, the Trademark Office will mail the "Priority Certificate" to the trademark agency.
