How to handle the pledge of the exclusive right to a registered trademark
If the exclusive right to use a trademark that is transferable according to law is pledged, the pledge shall be The party and the pledgee shall enter into a written contract for the pledge of the exclusive right to use the trademark, and apply to the Trademark Office for registration within the specified period from the date of conclusion of the contract. To apply for registration of pledge of exclusive trademark rights, the following documents should be submitted: (1) "Application Form for Registration of Pledge of Exclusive Right to Trademark" filled out in accordance with regulations; (2) Copies of the identity certificates of the pledgor and pledgee; (3) A copy of the pledge contract; (4) A copy of the "Trademark Registration Certificate" of the pledged trademark; (5) If an agent is entrusted to handle the registration, a power of attorney from the principal shall be submitted; (7) Other materials that should be submitted. If the registration application documents are complete and the application procedures comply with the regulations, the Trademark Office will accept it. The Trademark Office shall make a decision on whether to register the application within the prescribed time limit from the date of accepting the registration application. Those who meet the registration conditions stipulated by law will be registered and a "Trademark Exclusive Right Pledge Registration Certificate" will be issued; those who do not meet the conditions will not be registered. The trademark exclusive right pledge contract shall take effect from the date of registration. If the pledge is transferred due to the change of the applicant's name or address, the transfer of the principal debt or other reasons, the party concerned shall handle the change registration, supplementary registration or re-registration of the pledge of the exclusive right to use the trademark.
