What are the components of a trademark?
According to China’s new Article 8 of the Trademark Law stipulates: “Any visible sign that can distinguish the trademark of a natural person, legal person or other organization from the goods of others, including words, graphics, letters, numbers, three-dimensional signs and color combinations, And combinations of the above elements can be applied for registration as trademarks." Obviously, the legal constituent elements of a trademark are: "text, graphics, letters, numbers, three-dimensional logos and color combinations that can be visually distinguished, as well as combinations of the above elements."
In addition, the smell and sound of goods cannot currently be used as trademarks in our country.
As the text that constitutes the trademark, it can be Chinese characters (simplified or traditional Chinese characters, variant Chinese characters cannot be used), Chinese pinyin, ethnic minority scripts, English and other countries. Text or letters, numbers, and different text can be used in combination.
The above six types of trademark elements can be registered separately as trademarks , or any combination of two or more of the above elements, which may be the same or different, but must comply with the relevant provisions of Articles 8 and 9 of the Trademark Law.
As the color of the words, graphics, letters, numbers, three-dimensional signs or combinations thereof that constitute a trademark, if no specific color requirements are explicitly stated when applying for a registered trademark, All are registered in black and white and protected in black and white. If a designated color or color combination is clearly stated, the registration will be based on the designated color or color combination, and the designated color or color combination will also be protected.
