Article 93 of the "Patent Law Implementing Rules" shall refer to the State Council Patent Administration When applying for a patent and handling other procedures, the department shall pay the following fees:
(1) Application fee, application surcharge, publication printing fee, priority claim fee;
(2) Substantive examination fees and re-examination fees for invention patent applications;
(3) Patent registration fee, announcement printing fee, annual fee;
(4) Request fee for restoration of rights and request fee for extension of time limit;

According to the Patent Law: The patentee fails to pay or fully pay the annual fee and late fees as required , the patent right shall terminate from the expiration date of the previous year. If the patentee fails to pay the annual fees on time after the year in which the patent right is granted or the amount paid is insufficient, the patent administration department of the State Council shall notify the patentee to make up the payment within 6 months from the expiration date of the annual fees due, and at the same time pay a late fee.
