1. The works of foreigners and stateless persons shall be protected according to the agreement signed between the author's country or country of habitual residence and China or jointly participated in the work. International treaties;
2. Works by foreigners and stateless persons are first published in China;
3. Works by authors from countries that have not signed an agreement with China or jointly participate in international treaties, as well as foreigners and stateless persons, are published for the first time in a member country of an international treaty that China is a party to, or are published simultaneously in member countries and non-member countries.
Among the above three conditions, "the work is first published in China" means that the work of a foreigner or a stateless person is published in China and meets one of the following circumstances:
p>1. The works of foreigners and stateless persons have never been published in any country, and are first published in China through legal procedures;
2. Works by foreigners and stateless persons are first published outside China and then published within China within thirty days;
3. Foreign countries The works of persons and stateless persons have never been published in any country. They will be published in China after being adapted and translated with authorization.
Foreigners and stateless persons whose works meet the above conditions and are “first published in China” are qualified as Chinese copyright holders, and their copyrights are protected by the People’s Republic of China. Protected by the Copyright Law of the Republic of China, copyright property rights are also protected.
Foreigners and stateless persons enjoy the same treatment as Chinese copyright owners in calculating the protection period of their copyrights. The period of protection of their copyrights starts from the date the work is first published. , ends on December 31st of the fiftieth year after the death of the copyright owner.
