2. How to compensate the owner of infringing copies
One of the responsibilities of the owner of infringing copies is to compensate the rights holder for the losses. The calculation of the rights holder's losses shall be based on the "Supreme People's Court's Laws Applicable in the Trial of Copyright Civil Disputes" Interpretation of Several Issues" stipulates:
1. The actual loss of the right holder can be based on the reduction in the distribution of copies caused by the right holder due to infringement or the infringing copy. The sales volume is calculated by multiplying the unit profit of the right holder from the issuance of the copy. If the reduction in issuance is difficult to determine, it shall be determined based on the market sales volume of the infringing copy;
2. If the actual losses of the right holder or the illegal gains of the infringer cannot be determined, the People's Court shall determine the amount of compensation (less than RMB 500,000) based on the request of the parties or ex officio by applying the provisions of Article 48, Paragraph 2 of the Copyright Law;
3. If the parties reach an agreement on the amount of compensation in accordance with the provisions of Article 1, the People's Court shall allow it.
