What is a collaborative work? Works created jointly by two or more natural persons, or between natural persons and legal persons or other organizations, or by two or more legal persons or other organizations, are called collaborative works.
Article 13 of the Copyright Law of the People's Republic of China stipulates that for works jointly created by two or more people, the copyright shall be shared by the co-authors. People who have not participated in the creation cannot become co-authors. If the work can be divided and used, the authors can enjoy separate copyrights for the parts they created, but they cannot infringe the overall copyright of the collaborative work when exercising the copyright. It can be seen from this article that collaborative works should have the following characteristics:
1. The co-creators have a common way of expressing their thoughts and emotions, that is, they jointly create the work;
2. Co-creators should conscientiously implement their creative intentions during the creative process, and the creative results of various places should support each other;
3. Co-creators should fully complete the content they are responsible for in the collaborative creation, that is, they should fulfill their obligations in collaborative creation and safeguard the rights of the co-creators during the creation process;
4. Those who do not participate in the creation and only provide material conditions, consultation, data collection, revision opinions or copying for the cooperation of the creator cannot become the creator of the collaborative work.
